Acceptable Use Policy (AUP)

Before signing up to hosting with JMF eMedia Web Services we recommend you read through this AUP to make sure your web site abides by all the rules and regulations. If we find your site does not abide by this policy after you have signed up and agreed to it you will be given a warning to remove any data that is not abiding with this AUP. If you refuse to remove the data we will terminate your account in accordance with this AUP. No Refund will be given.
Un-Acceptable Content
We do not allow the hosting of any web sites that might include or display content relating to the following:
- Pirate/Illegal/Copied/Copyrited Software
- License keys for Copyrighted software
- Hacking Programs, Tips, Tutorials, Archives, Information
- Warez - Copyrighted software distributed/sold to third parties.
- Illegal Music Files (Copyrighted)
- Pornography (Any)
- Un-Acceptable Drugs sales, in accordance with UK Laws (Class 3 and Above)
- Un-Acceptable Drug Information, in accordance with UK Laws (Class 3 and Above)
- Scripts that cause an Excessive drain on the CPU of the Server. More than 10%.
- Impersonation of other web sites, including banks, shops, Phishing etc.
Broadcasting
Here at JMF eMedia Web Services we do not support the broadcasting of illegal or copyrighted media through our servers. This includes but is not limited to pornography, copyrighted mp3s etc... Illegal or Copyrighted Media refers to anything that may violate UK or US Law. We may terminate or suspend your account(s) if we have evidence of this taking place.
Reselling of Services
If you have a shared hosting plan with JMF eMedia Web Services you are not permitted to resell hosting services to anyone. Consequences of this are the immediate termination of your account with no refund. Reselling of services includes disk space, bandwidth, databases, ftp accounts, email accounts, installed scripts, IP Addresses, SSL Certificates. You may however host multiple personal domains on your account as long as they are in the form of a non-profitable organisation e.g. a BLOG. A shop would be classed as a profitable organisation.
If you have a reseller hosting plan with JMF eMedia Web Services you are permitted to resell hosting services using the WHM tool that is created for you on account setup. You will be given the URL to this tool when your account is created. All sites created by a reseller, must abide by our Acceptable Use Policy. If a resellers sub account violates our AUP we will suspend the sub account in question and contact the reseller.
SPAM
While hosting your web site on JMF eMedia Web Services servers we understand that you may need to send out certain marketing emails to sell your product or service. If we receive a complaint about SPAMMING then we will suspend your account pending Investigation. If our conclusions result in a positive outcome to the offence then we will remove you from our servers with no refund.
We take SPAM very seriously and if we see that your account is sending out excessive amounts of emails then we will not hesitate to remove you from our servers.
We class SPAM as attacking of servers, scripts and message boards, email threats, mass marketing emails that cannot be directly traced.
Other AUP Violations
If we see that your site is using excessive server resources then we may suspend your account and contact you regarding the issue. If the issue is not resolved within a reasonable time period decided by us then we may terminate your account with us. Usually we will look into this issue with you so that both parties come to an amicable decision. Excessive usage is classed as 10% or more of the overall server load.
If any fines or fees are incurred due to the storage, broadcasting or distribution of any sort of media we may pass these fines onto the client.
Reporting of AUP Violation
If you find a web site AUP Violation it must be reported immediately to support[at]jmfemedia[dot]net. You must include as much detail about the violation as possible so that it can be followed up and appropriate action can be taken against the user. This should be done in order to keep our servers secure and safe and so that we can provide an overall better environment for you to host your web site.
Termination of Service
JMF eMedia Web Services reserve the right to request the removal of any website(s) from our server(s) with no reason and 1 months notice given. If the client needs to be reimbursed for any hosting that is not used, it will be refunded on a prorata basis by cheque or bank transfer. If the website(s) in question are not removed after a 1 month period, they will be suspended for a period of 3 months. They will then be terminated after this period.
This Acceptable Use Policy (AUP) may be altered at anytime without notification Please note if alterations are made you will be subject to any changes.
